§ 114-142. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them:

    Abandoned vehicle means a vehicle which has remained on private property for any amount of time without the permission of the real property owner or public property for a period of 48 hours after a police agency or other governmental agency designated by the police agency, if required by law, has affixed a written notice to the vehicle. A vehicle is also an abandoned vehicle if, with a valid registration tag affixed to it, it is parked on a state trunk line highway for not less than 18 hours or if, without a valid registration tag affixed to it, it is parked on a state trunk line highway for any period of time.

    Emergency towing means the towing, carrying, pushing, or otherwise transporting for a fee any motor vehicle, disabled in any manner, from any road, street or freeway in the city or from the scene of any accident by a service truck or a single crane tow truck under the weight of 26,000 pounds.

    Owner of a vehicle shall mean the titled owner, the registrant or the lessee of the vehicle.

    Person shall mean a person as defined by section 1-2 of the Ypsilanti City Code.

    Standard tow, for rate purposes only, means the removal of any wrecked, disabled or abandoned vehicle, weighing 10,000 pounds or less, from the traveled portion or berm of a highway by a service truck or a single crane tow truck that weighs under 26,000 pounds and towing to any location. A standard tow shall include the removal of all debris, not including hazardous material, from the street.

    Wrecker means a person engaged in the business of, or offering services of, a vehicle wrecker or towing service, whereby disabled motor vehicles are or may be towed or otherwise removed from one place to another by the use of a motor vehicle adapted to and designated for that purpose.
