§ 42-55. Penalties.

  • (a)

    Any person convicted of violating any provision of this division for the first time, in addition to being required to remove or pay for the removal of graffiti, shall be guilty of a blight violation, and shall be punished by a fine as set forth in the section 71-73.

    (b)

    Any person convicted of violating any provision of this division for the second time, in addition to being required to remove or pay for the removal of graffiti, shall be guilty of a blight violation, and shall be punished by a fine as set forth in section 71-73.

    (c)

    Any person convicted of violating any provision of this division for the third time, in addition to being required to remove or pay for the removal of graffiti, shall be deemed guilty of a blight violation and shall be punished by a fine as set forth in section 71-73.

    (d)

    When found guilty of an infraction as noted in either subsection (a) or (b) of this section, it shall be the court's option to require the monetary fine, or to substitute community service to be accountable at the then minimum wage rate.
