§ 90-101. 2013 Streetlight special assessment roll.

  • (a)

    The special assessment roll shall be designated "2013 Streetlight Special Assessment Roll" (the "roll") and the district against which it is spread shall be designated "2013 Streetlight Special Assessment District" (the "district").

    (b)

    City council determines that the assessments are in proportion to benefits derived or to be derived by added safety, security, deterring crime, reducing carbon footprint, assisting in the ease of movement on streets and sidewalks, lessening the danger of collisions, and positively affecting property values such that the market values of the assessed properties in the district will increase or have increased as a result of the improvement.

    (c)

    The roll in the amount of $555,664.00 filed by the city assessor with the city clerk and presented to city council for review and certification and filed in the office of the city clerk, as corrected or amended by city council, is confirmed and is ordered to be filed in the office of the city treasurer.

    (d)

    The city clerk shall endorse the roll with the date of the confirmation.

    (e)

    The roll shall be final and conclusive unless an action contesting an assessment is filed in a court of competent jurisdiction within 30 days after the confirmation.

    (f)

    The roll shall be divided into two equal annual installments, the first installment due December 1, 2013, and the second installment due December 1, 2014.

    (g)

    The assessments made in the roll are ordered and directed to be collected and the city clerk shall thereupon deliver to the city treasurer the roll, to which she shall attach her warrant commanding the city treasurer to collect the assessments in accordance with directions of the city council with respect thereto, and the city treasurer is directed to collect the amounts assessed as the same become due.

    (h)

    All special assessments and all interest and charges thereon, from the date of the confirmation of the roll, shall be and remain a lien upon the property assessed of the same character and effect as the lien created by the general law for state and county taxes, and by the city Charter and chapter 90 of the Code for city taxes until paid.

    (i)

    The amount due on the first installment on the roll, if not paid on or before 30 days next following the due date of the first installment, shall have a five percent collection fee added. Remaining installments becoming due between September 1 and August 31 in any annual period, shall be payable on May 1 of such period. If unpaid after June 1 of such period, a five percent collection fee shall be added. On October 15 of each year, the city treasurer shall make return, duly certified by her, of all installments on special assessments rolls together with the collection fee of five percent which are due and have remained unpaid to the city council for approval. The city council shall approve the special assessment roll and order the city assessor to levy and assess the special assessment on the general tax roll for that year in the columns provided for special assessments.

    (j)

    At the expiration of the first 30-day collection period, the city treasurer shall certify to the city clerk the unpaid balance on the roll and the city clerk shall advertise for and secure bonds to cover such balance, or otherwise finance such unpaid balance.
